General Terms of Sale
Version of 4 July 2026 — pending validation
1. Purpose and scope — These General Terms of Sale (GTS) apply to any order of AvantBail services (56 Rue Vasco de Gama, 75015 Paris, France — bonjour@avantbail.com — +33 6 50 40 50 00) placed through avantbail.fr or by accepted quote, by a business or consumer client. Any order implies full acceptance of these GTS.
2. Services — AvantBail offers: a free address pre-diagnostic; the AvantBail Report (€799 excl. VAT); the full implantation study (€3,500 to €7,500 excl. VAT depending on scope); the strategic franchise and multi-site study (from €10,000 excl. VAT); and kitchen-engineering, site-works follow-up and brand-identity services (AvantBail Studio) per the published ladder or on quote. The exact scope of each service is confirmed in writing before any payment.
3. Nature of the deliverables — AvantBail deliverables are decision-support studies and pre-diagnostics. Every element is qualified as confirmed, likely or to verify. They are neither a legal or regulatory guarantee, nor a regulatory audit, nor legal, financial or accounting advice, and do not replace the checks of the relevant professionals (lawyer, notary, accountant, architect, inspection body).
4. Order — The order is formed upon AvantBail's receipt of the complete request (exact address of the premises and required information) and the client's written confirmation (accepted quote or online order validation), followed by payment as agreed.
5. Prices and payment — Prices are stated exclusive of tax; VAT at the applicable rate is added. Unless stated otherwise in the quote, payment is due at the time of order. For business clients, late payment automatically incurs penalties at the ECB rate plus 10 points and the €40 fixed recovery indemnity (Articles L441-10 and D441-5 of the French Commercial Code).
6. Delivery — The AvantBail Report is delivered within 24 business hours of receiving the full address and the required information. Studies are delivered per the schedule agreed in the quote. Deadlines run from the effective receipt of the information requested from the client.
7. Right of withdrawal (consumers) — Consumers have 14 days to withdraw (Article L221-18 of the French Consumer Code). For a service or digital content whose performance the consumer requests before the end of that period (for example a report delivered within 24 hours), the consumer expressly agrees to immediate performance and acknowledges losing the right of withdrawal once the service is fully performed (Articles L221-25 and L221-28). Business clients have no right of withdrawal.
8. Liability — AvantBail is bound by an obligation of means. Analyses rely partly on third-party data sources (public authorities, open databases, data providers) which may contain errors, delays or gaps; the deliverables flag the corresponding points to verify. AvantBail's liability is capped at the amount actually paid for the service concerned, except in cases of gross negligence, wilful misconduct or personal injury.
9. Intellectual property — Reports and studies are delivered for the client's internal use within their project (including sharing with their advisors, partners and financers). Their resale, publication or public distribution without AvantBail's written consent is prohibited. Methods, analysis grids and tools remain AvantBail's property.
10. Personal data — The processing of order-related data is described in the privacy policy accessible from the footer.
11. Consumer mediation — In line with Articles L612-1 et seq. of the French Consumer Code, consumers may use a consumer mediator free of charge: to be completed before validation (mediator designation and contact details). European online dispute-resolution platform: ec.europa.eu/consumers/odr.
12. Governing law and disputes — These GTS are governed by French law. Failing amicable resolution, the courts of Paris have jurisdiction for business clients; consumers may bring proceedings before the courts of their place of residence under the applicable rules.
